Judge Charles S. Haight, Jr. denied motions to dismiss the Government's civil RICO suit against the New York carpenters' District Council, which alleged control of the Council by members of the Genovese family through bribery and extortion.

United States District Court for the Southern District of New York, decided 20 November 1991. The case "invokes the civil RICO statute, 18 U.S.C. § 1964, to obtain injunctive relief against a labor organization, certain of its present and former officers, and other individuals." The District Council "represents about 22 local unions in the construction trade industry."

The court summarizes the Supplemental Complaint. It alleges that Anthony Salerno, Vincent and Louis DiNapoli, Peter DeFeo, Alexander Morelli and Liborio Bellomo held positions in the Genovese family and, aided by officers of the District Council, acquired and maintained control of the Council through bribery and extortion. The Government asked the court to bar the defendants from union affairs, to enjoin the officer defendants from racketeering and from associating with organized crime, and to appoint a court liaison officer and a trustee.

"The case is before the Court on certain defendants' motion to dismiss the Supplemental Complaint. For the reasons set forth below, the motion is hereby denied." These are allegations at the pleading stage, not findings. Several officers named in the opinion may be living, and this page names only the alleged family members the complaint lists. Later opinions in the case have not been opened.
