First Circuit opinion of October 16, 2007 affirming the denial of former FBI agent John J. Connolly, Jr.'s motion for a new trial on newly discovered evidence.

United States Court of Appeals, First Circuit, October 16, 2007 (Selya, J.). Connolly moved for a new trial on newly discovered evidence. The district court denied the motion, and the appeals court held that it "acted within the encincture of its discretion in denying the motion."

The background states that Connolly handled "top echelon" informants Bulger and Flemmi until his 1990 retirement, and that an indictment "scheduled to be rolled out on January 10, 1995, targeted the two quondam informants as well as several other mobsters." The court continues: "two of the targets — Bulger and Francis ('Cadillac Frank') Salemme — fled before the indictment was unsealed." Salemme was apprehended in Florida nearly eight months later.
