Seventh Circuit opinion of June 18, 1958 affirming the decree that revoked Paul De Lucia's 1928 naturalization.

United States Court of Appeals, Seventh Circuit, decided June 18, 1958. The appeal is from a decree in a denaturalization proceeding brought under § 340(a) of the Immigration and Naturalization Act of 1952.

The opinion recites the government's complaint, filed October 10, 1956, which alleged that on or about April 10, 1928 De Lucia, "who was born in Naples, Italy, on or about November 14, 1897," was naturalized, and that in his declaration of intention he had sworn that his name was Paul Maglio. The caption names him "Paul De Lucia, also known as Felice De Lucia."

The opinion quotes the district court's finding that "the government has conclusively shown that the defendant, Paul De Lucia, was not Paul Maglio, born July 10, 1898." It concludes: "the decree of the district court is affirmed." The birth date above is the government's allegation as the court recites it, not a finding.
