District court ruling of June 21, 1991 that the Government had not shown that Raymond J. Patriarca, charged under RICO with Travel Act predicates, should stay detained before trial; release conditions were set.

United States District Court for the District of Massachusetts, Judge Mark Wolf. The ruling concerns pretrial detention. The court summarizes the charge: "the Defendant Raymond J. Patriarca, also known as Junior, is charged with a violation of the Racketeer-Influenced Corrupt Organization ('RICO') statute. The predicates are premised on violations of the Travel Act, two of which relate directly to alleged extortions." He had been arrested on March 22, 1990.

"The Government has opposed the request that Mr. Patriarca now be released and seeks his continued detention based on both dangerousness and risk of flight." The court found that the Government had not proved a risk of flight by a preponderance of the evidence, or dangerousness by clear and convincing evidence, and set release conditions that included home confinement and limits on his communications. The order is dated July 1, 1991 and was corrected on July 15, 1991.

The opinion also discusses personal matters bearing on detention. This page does not repeat them. The Government's appeal was decided in [948 F.2d 789](/items/courtlistener-us-v-patriarca-948-f2d-789/).
