The three-judge court adjudges Pendergast, O'Malley and McCormack in contempt over the insurance-rate settlement; the Supreme Court later records two years' imprisonment for Pendergast and O'Malley and two years' probation for McCormack.

The opinion adjudges the three men in contempt of the court over the insurance-rate settlement. The sentences are as the Supreme Court describes them (317 U.S. 412, 416): two years' imprisonment for Pendergast and O'Malley and two years' probation for McCormack; this opinion's own sentencing text was not read. The contempt convictions were later reversed on limitations grounds; see the 1943 opinion.
