Judge Keenan's pretrial ruling of October 2, 1985 in the Colombo family RICO case, denying motions for severance and transfer. It gives the Commission case's district docket as "United States v. Salerno, S 85 Cr. 139 (RO)."

United States District Court, Southern District of New York, docket S 84 Cr. 809 (JFK), opinion and order of October 2, 1985 by District Judge Keenan. The court describes the case: "The fourteen defendants are alleged to be members and associates of the Colombo Family of La Cosa Nostra." Counts one and two of the 51-count indictment charge all fourteen with RICO offenses. These are allegations stated before trial.

Three defendants asked to move part of this case into the Commission prosecution. The court writes that they "move for an order pursuant to F.R. Cr.P. 13 severing a portion of the indictment and joining it for trial with the indictment in United States v. Salerno, S 85 Cr. 139 (RO). For the reasons stated below, these motions are denied." The Commission case's district docket number is read here, in this opinion. It is not printed in the appeal ([868 F.2d 524](/items/us-v-salerno-868-f2d-524/)) and is not given as that page's docket.

The Second Circuit later affirmed the convictions in this case ([832 F.2d 705](/items/courtlistener-us-v-persico-832-f2d-705/)).
