On a Government appeal in the prosecution of Teamsters president Jackie Presser and two others, the Sixth Circuit vacated a pretrial order to disclose "any and all impeachment evidence." The opinion recites the 1986 indictment over "ghost" employees at Local 507.

United States Court of Appeals, Sixth Circuit, decided 25 April 1988. The Government appealed a pretrial discovery order in the criminal case against Jackie Presser, Harold Friedman and Anthony Hughes.

The opinion recites the charge: "On May 16, 1986, a federal grand jury handed up an indictment charging that Presser, Friedman and Hughes abused their positions as local union officers by conspiring to employ and by employing 'ghost' employees at Local 507" of the Teamsters and at a bakery workers' local. The indictment charges that Presser, "as the Secretary-Treasurer of Local 507," Friedman and Hughes "caused union funds to be paid to supposed union employees ... for services which the defendants knew none of the recipients of the funds had rendered." The defendants said they would argue that "Presser and Hughes were 'cooperating citizens'" for the FBI and that the FBI had authorized what they did.

The district court had ordered the Government to disclose "any and all impeachment evidence." The Sixth Circuit held the order too broad and vacated it. The indictment is a charge, and this opinion makes no finding of guilt. No record filed here states how the case ended.
