The Second Circuit affirmed the convictions of Anthony M. Scotto, president of ILA Local 1814 in Brooklyn, and Anthony Anastasio on forty-three counts, including RICO counts, for cash payments from waterfront businesses in 1975 to 1979.

United States Court of Appeals, Second Circuit, argued 20 May 1980 and decided 2 September 1980. Judge Oakes wrote the opinion.

"Anthony M. Scotto and Anthony Anastasio, not contesting the sufficiency of the evidence, appeal from judgments of convictions on forty-three counts entered after an eight-week jury trial in the United States District Court for the Southern District of New York, Charles E. Stewart, Judge." The counts included RICO and RICO conspiracy. The court states: "From 1975 through 1979, appellant Scotto was president of ILA Local 1814 in Brooklyn and vice president for legislative affairs for the ILA nationally."

The opinion summarizes the evidence of more than forty cash payments from six waterfront businesses. The chief executive of John W. McGrath Corp., a Brooklyn stevedoring company, paid Scotto $15,000 a quarter and $5,000 at Christmas, $65,000 a year, for help in reducing workmen's compensation claims. Scotto testified in his own defense. He denied receiving payments from two of the payers before January 1977, and said he had accepted the later payments only as a conduit for political campaign contributions. The court concluded: "Accordingly, the judgments are affirmed."
