The FBI's Office of Congressional and Public Affairs answers a Pennsylvania legislative research analyst with summaries, photographs and a list of alleged members of the 'Capone gang' 'per information furnished in 1936', noting that the gang's activities were mostly outside federal jurisdiction.

Part 22 of the FBI Vault's Capone file, scans 84 to 87. Scan 86 is an internal memorandum of August 15, 1983 recording a telephone request from a research analyst of the Pennsylvania House of Representatives for material on Capone and members of his gang, and assigning the work to the Research Unit. Scans 84 and 85 are the reply of August 26, 1983, signed by the Assistant Director in Charge of the Office of Congressional and Public Affairs. Scan 87, stored here, is the enclosed list. This archive does not name the requester, a private individual.

As far as the OCR of scan 84 can be read, the reply says that the activities ascribed to the Capone gang did not, for the most part, constitute violations of federal law within the investigative jurisdiction of the FBI or its predecessor, the Bureau of Investigation. It encloses a list of alleged members furnished in 1936 by officials in Chicago, references to published books and magazines, summaries of the criminal careers of some alleged associates, and available photographs. It notes that the material was furnished from Research Unit files.

The list on scan 87 is headed "Alleged members of the 'Capone gang' per information furnished in 1936" and gives thirty-eight names, among them Tony Accardo, Louis Campagna, Ralph Capone, Jake Guzik, Frank Nitti, Frank Rio and Johnny Torrio, with a note that "Those names followed by '(D)' were deceased in 1936." The same thirty-eight names, with the same names marked as dead, appear under "Capone Gang (South Side)" in the Chicago office's memorandum of 28 July 1936 in Part 09. That memorandum records the list as obtained from a Cook County coroner's firearms expert. The list is an attribution by local officials as relayed by the FBI, not a finding about any person's role; this archive does not copy it onto a family chart.
