Accardo gave his residence as River Forest and invoked the Fifth Amendment on his occupation, birthplace and citizenship. Chief counsel Kennedy asked whether he took over the Capone syndicate in 1943 and showed a photograph of him with Giancana; he declined every question.

Part 33 of the McClellan Committee's hearings covers the restaurant industry in the Chicago area, July 1958. Anthony J. Accardo testified on 11 July 1958 (pp. 12782-12790) with counsel Harry Clifford Allder. He gave his residence as River Forest and invoked the Fifth Amendment on his occupation, birthplace and citizenship. His counsel asked, without success, that the television cameras be turned off.

Chief counsel Robert Kennedy put to him that a photograph, Exhibit 22 (p. 12785), showed him with "Mooney" Giancana, and said that "Mr. Giancana is one of the most important and perhaps one of the two or three most important underworld figures in the Chicago area." He asked (p. 12786) whether Accardo "took over as the head of the Capone syndicate in 1943" and whether he and Paul Ricca were "the two most important figures in Chicago." Accardo declined to answer each question.

The statements about Giancana, about 1943 and about Ricca are counsel's questions. The witness answered none of them, and none is a finding. Quotations follow the Internet Archive's OCR of the printed volume. Page numbers are the printed running heads and can be off by one near a page break.
