The first page of the 29-page W.D. Mo. case file is an indictment charging Adam Richetti, Charles Arthur Floyd alias 'Pretty Boy' Floyd, and Vernon C. Miller alias Verne Mason alias Verne Moore with conspiring to violate federal law concerning the custody of Frank Nash, an escaped Leavenworth prisoner.

The National Archives at Kansas City (Record Group 21) holds this criminal case file, local identifier SS101, with 29 digitized pages. Page 1, stored here, is an indictment captioned "United States of America vs. Adam Richetti, No. 12777," in the District Court of the United States for the Western District of Missouri, Western Division. The grand jurors "present and charge that one ADAM RICHETTI, whose true name other than set forth is to this grand jury unknown, and Charles Arthur Floyd, alias 'Pretty Boy' Floyd, and Vernon C. Miller, alias Verne Mason, alias Verne Moore, and divers other persons ... did enter into an unlawful conspiracy to violate the laws of the United States."

It recites that Frank Nash was on 1 March 1924 convicted in the Western District of Oklahoma, at Oklahoma City, of assaulting a United States mails custodian and sentenced in accordance with that conviction; the next pages recite his escape from the penitentiary at Leavenworth on 19 October 1930. Scans 001 to 003 were read; the indictment's own date was not read, and the remaining 26 pages were not.

An indictment is a charge, not a finding. The FBI's history essay gives the sentence date as 3 March 1924; the indictment says 1 March, and each is cited as it states.
