A three-image file from the Roosevelt White House: a memorandum of 10 July 1936 recording that the President, on the Attorney General's advice and Governor Lehman's recommendation, revoked the commutation of Ignazio Lupo's sentence and ordered him returned to Atlanta, and a telegram telling the Governor.

The National Archives catalogs this item as "OF 2126: Lupo, Ignazio 1936," in the President's Official File at the Franklin D. Roosevelt Library. The digitised file holds three images: a folder tab, a memorandum and a telegram.

The White House memorandum, dated 10 July 1936 and shown here, reads that "The Attorney General advised the President that he was of the opinion that the record fully warrants his revoking the commutation of the sentence of Ignazio Lupo in accordance with the recommendation of Governor Lehman," and that on that date the President "commanded the United States Marshal for the Southern District of New York to apprehend the said Ignazio Lupo" and deliver him to the Warden at Atlanta, Georgia, to serve the rest of his original term. It ends: "Order of Revocation signed by the President and returned to the Department of Justice, July 10, 1936." Pencil marks beside the text include the note "Pres. Harding." The telegram, from the Assistant Secretary to the President, informs Governor Lehman of the revocation.

The file does not state the grounds. The Fifth Circuit's 1937 opinion quotes the revocation order's grounds ([92 F.2d 362](/items/courtlistener-lupo-v-zerbst-92-f2d-362/)). This record falls outside 1890-1920 and is filed to complete the sequence of Lupo's federal records.
