Page 2 of the Evening Star, Tuesday, 6 November 1928 (election day), carries in its right-hand column a story headed “ROTHSTEIN WOUND RESULT IS FATAL,” with the deck “Famous New York Gambler Dies, Refusing to Reveal Identity of Slayer.” It is credited “By the Associated Press” under a NEW YORK, November 6, dateline.

The dispatch reports that Arnold Rothstein “died today refusing in accordance with the code of the underworld to reveal the identity of his slayer,” and that he “was shot Sunday night in a hotel room to which he was lured by a telephone call.” As background it says he “was a witness at the trial of Police Lieut. Charles Becker for the murder of Herman Rosenthal,” that he “was once charged with having “fixed” the 1919 world series,” and that he “was indicted in connection with the Fuller-McGee brokerage bankruptcy case.” It adds that, “by his own avowal, he had largely given up gambling to devote himself to his real estate business.”

The background lines are the wire service’s summary of earlier charges and reports; the page records them as charges, not as proven facts, and so does this archive. This archive takes from the page the date of death and the circumstance that he named no one.
