United States Court of Appeals, Sixth Circuit, argued April 26, 2002, decided and filed September 10, 2002; rehearing denied November 13, 2002 (the date CourtListener shows). Opinion by Circuit Judge Moore.
The court states: “Paul and Anthony, along with fifteen others, were charged in a twenty-five count indictment.” It summarizes: “Paul and Anthony were allegedly members of the Detroit Cosa Nostra; Paul, the nephew of Anthony, engaged in a scheme with Nove Tocco to ‘shake down’ bookmakers in the Detroit metropolitan area, allegedly under the supervision of Anthony, a Mafia ‘capo,’ and others.” Each of those descriptions is marked by the court as an allegation.
After the remand ordered in 227 F.3d 528, the district court reinstated the convictions. The Sixth Circuit held: “we AFFIRM the reinstatement of the Corrados’ convictions and Paul’s sentence, but we VACATE Anthony’s sentence and REMAND the district court for resentencing.” It cites a further forfeiture opinion, United States v. Corrado, 286 F.3d 934 (6th Cir. 2002), which has not been opened for this archive.
