United States Court of Appeals, Third Circuit, August 31, 1994; argued March 7, 1994. Anthony DiSalvo and the attorney Robert F. Simone appealed RICO and extortionate-collection convictions. The court said that, of the issues raised, “of most concern is the question of the sufficiency of the evidence of implied threats which supports the convictions of using extortionate means to collect a debt.”

The opinion describes Simone’s alleged part in the Rouse extortion and in collecting a loan the court calls “the Pelullo loan” through the implied threat of Scarfo and Philip Leonetti. It states that “recorded conversations between Simone and FBI cooperative, David Kurzband, an Atlantic City casino junket operator, established Simone’s familiarity with both the members and the functioning of the Scarfo operation.”

Simone was a private individual convicted in this case; he is named here only as the court names him.
