United States Court of Appeals, Second Circuit, decided January 8, 1962. Carmine Galante and Anthony Mirra were defendants in a narcotics-conspiracy trial in the Southern District of New York that ended in a mistrial. The trial judge held them in criminal contempt for their conduct in the courtroom and sentenced them.

On Galante, the court’s disposition is short: “Galante’s appeal is dismissed as moot.”

The opinion concerns courtroom conduct and contempt. It says nothing about Galante’s place in any organization.
