United States Court of Appeals, Second Circuit. Argued October 25, 1993, decided October 24, 1994, before Judges Van Graafeiland and Winter and District Judge Pollack; the opinion is by Judge Winter. The appeal is captioned under Vincent Gigante, the first-named defendant in the indictment, but Gigante is not an appellant. The appellants were convicted by a jury before Judge Dearie of extortion and conspiracy to commit extortion.
Viewing the evidence “in the light most favorable to the government,” the court wrote: “Mangano and Aloi were senior members of the administration of the Genovese and Colombo crime organizations, respectively.” It says they took part from 1978 in a conspiracy to control the window-replacement market in the New York area, mainly through bids on New York City Housing Authority contracts.
The main issue was the sentences. After upward departures, “Mangano was sentenced to 188 months, and Aloi to 200.” The court rejected the appellants’ arguments and affirmed.
