United States District Court, Eastern District of New York, No. CR 93-368(JBW), memorandum of October 29, 1997 by District Judge Weinstein. Zachary W. Carter, U.S. Attorney, appeared for the government.
The memorandum reviews the trial evidence before imposing sentence. The court wrote that the evidence “demonstrated without a reasonable doubt that Mr. Gigante had been the boss of the Genovese Crime Family since at least 1985.” It is a court’s statement after a jury verdict.
The court also summarized testimony about the 1985 killing of Paul Castellano: “His murder had not been approved by the Commission made up of the leaders of each mafia family.” That sentence reports what witnesses said; the court did not try that killing. The Second Circuit affirmed the judgment in 166 F.3d 75.
