United States Court of Appeals, First Circuit, October 30, 1981. Six defendants appealed convictions after a 46-day trial on a 42-count RICO indictment. The indictment alleged an enterprise “composed of individuals associated in fact to fix by bribery horse races at various race tracks and to profit from this activity by wagering on those races,” from about December 1973 to about November 1975. Anthony Ciulla was the Government’s principal witness.
The court affirmed the convictions of Howard T. Winter, James Martorano, Melvin Goldenberg and Elliot Paul Price, and reversed those of James and Charles DeMetri. The opinion mentions the “Winter Hill area” once, as the place to which bettors were told to return with their winnings.
This opinion does not mention Bulger, Flemmi or Patriarca. It is filed because Part 01 of the FBI’s Bulger file, also filed, holds race-fixing reports of 1976 to 1978 and what appears to be a copy of this opinion. This archive has not confirmed that the Bureau’s race-fixing file and this prosecution are the same matter.
