Published by the Federal Bureau of Investigation on fbi.gov with no third-party credit, and treated here as a United States government publication, public domain under 17 U.S.C. § 105. The FBI history page does not say the Bureau took the photograph. The FBI serves it at the cited URL; a copy downloaded from it on 12 October 2026 is stored here.

The FBI image repository titles this entry “Al Capone Mugshot” and captions it “Mug shot of Al Capone on May 16, 1929.” It is the lead image on the FBI history page Al Capone. The repository lists the file at 52 KB.

The copy shown here is the original file, downloaded from the FBI image repository on 12 October 2026. The same photograph is held by the National Archives as a print in the New York Times Paris Bureau file, and a copy of that print is stored on its own page: NAID 24520406.

The date is not settled by the records. The FBI caption says May 16, 1929. The placard on the National Archives print shows the number 90725 and a date of 5-16 or 5-18 of ‘29; a National Archives volunteer transcription reads it “5 18 1929”. The National Archives’ 1997 American Originals exhibit captions the same print “Al Capone, 1930”. The FBI history page says Capone was arrested in Philadelphia on May 17, 1929, for carrying concealed deadly weapons. This page records the conflict and does not resolve it.
