A grand jury indictment of the March Term 1931 in the District Court for the Northern District of Illinois, Eastern Division. The caption names the defendant as “Alphonse Capone, alias Alphonse Brown, alias Al Capone, alias Al Brown, ‘Scarface’ Brown, alias ‘Scarface’ Capone, alias A. Coste.” Later papers in the same case spell the last alias “A. Costa.”

The first page charges that on March 15, 1925, he willfully attempted to evade and defeat an income tax of $32,489.24 imposed by the Revenue Act approved June 2, 1924. The U.S. Attorney’s summary of the two indictments gives the net income behind that figure as $123,101.89. The catalog holds the indictment as four page images and a PDF.

The case was consolidated with No. 23232 for trial. The jury’s verdict of 17 October 1931 finds Capone not guilty “as charged in Indictment No. 22852.”
