Supreme Court of the United States, decided March 10, 1969, together with Ivanov v. United States and Butenko v. United States.

The opinion states that the petitioners had been convicted of conspiring to transmit murderous threats in interstate commerce, that the Tenth Circuit affirmed (371 F.2d 983), and that certiorari was first denied. “In their petition for rehearing, petitioners alleged they had recently discovered that Alderisio’s place of business in Chicago had been the subject of electronic surveillance by the Government.”

The Court withdrew its earlier order, granted rehearing and certiorari as to Alderisio and Alderman, and vacated and remanded the judgments for proceedings on the surveillance records. The decision is cited for its rules on standing and disclosure of unlawfully overheard conversations; this page records only what it says about this case.
