United States Court of Appeals, Tenth Circuit, decided March 31, 1970.
The opinion states: “Appellant Alderisio was initially convicted in 1965 with two co-defendants” of conspiring to transmit murderous threats in interstate commerce (18 U.S.C. §§ 371, 875(c)), and that the court sentenced him to four and one-half years’ imprisonment with a fine of $7,500. It notes that co-defendant Ruby Kolod had died and that Willie Israel Alderman had dismissed his appeal.
The appeal concerns the post-Alderman hearing on the government’s surveillance records, including the monitoring of two businesses. Disposition: “The case is remanded for the limited purposes designated herein and the judgment is otherwise affirmed.”
