Docket entries in United States v. Basciano, No. 1:05-cr-00060, before Judge Nicholas G. Garaufis. The minute entry for June 1, 2011 records the penalty phase: closing arguments, the charge, and “JURY DELIBERATIONS BEGIN; JURY RENDERS A SENTENCE OF LIFEIMPRISONMENT WITHOUT THE POSSIBILITY OF RELEASE; SEE VERDICT SHEET.” The government had sought the death penalty; the jury did not return it.

Sentencing was held on July 20, 2011. The judgment imposes 120 months on Count One of the S-12 superseding indictment, “to run concurrently with his undischarged term of Life imprisonment,” and life imprisonment on Count Two, “to run consecutively to his undischarged term of life imprisonment.” The undischarged term is the life sentence in his earlier case. On April 22, 2016 the clerk entered the Second Circuit’s mandate: “It is Ordered that the Judgment entered on July 21, 2011, is AFFIRMED.” The appeals court’s opinion or summary order was not opened for this archive.
