United States Court of Appeals, Third Circuit, June 6, 1983; argued November 15, 1982. Local 54 challenged provisions of the New Jersey Casino Control Act of 1977, which authorized licensing of Atlantic City hotels for casino gambling and created the Casino Control Commission and the Division of Gaming Enforcement. The court vacated the denial of a preliminary injunction and remanded.
The opinion states that the union “has approximately 12,000 members of whom over 8,000 are employed as waiters, waitresses, bartenders, cooks, kitchen help, housekeepers and other hotel service employees in those establishments in Atlantic City, New Jersey, licensed to operate” casinos.
This opinion does not mention Scarfo or Bruno. It is filed as the first federal stage of the dispute whose later stage, Local 54 v. Read, states the Casino Control Commission’s 1982 finding about Scarfo.
