United States Court of Appeals, Third Circuit, November 2, 1987; argued August 4, 1987, rehearing denied December 4, 1987. The court rejected Local 54’s First and Fourteenth Amendment challenges to sections 86(f) and 93 of the New Jersey Casino Control Act.

The facts section states that on September 28, 1982 the Casino Control Commission ordered union president Frank Gerace and business agent Frank Materio removed. “The basis for the Commission’s order was a finding that Gerace and Materio were disqualified under Sec. 86(f) of the Casino Control Act as a result of their association with Nicodemus Scarfo, a reputed member of organized crime.” The opinion spells the name “Nicodemus.”

That is a state commission’s finding as the federal court reports it. The words “reputed member” are the Commission’s. The state-court proceeding the opinion cites was not opened for this archive.
