United States Court of Appeals, Third Circuit, July 22, 1982; argued March 30, 1982. The caption reads “Nicodemo Scarfo, a/k/a Nicholas Scarfo, a/k/a Nicholas Scarto.” The court affirmed his conviction under 18 U.S.C. App. § 1202(a) for possession of a firearm by a convicted felon.
The opinion recounts that investigators from the Atlantic County Prosecutor’s Office searched Scarfo’s residence in Atlantic City on December 23, 1979 under a warrant in a state murder investigation. “Scarfo was subsequently arrested, tried, and acquitted of the state murder charge. Thereafter, on January 20, 1981, he was indicted by a federal grand jury” for possessing “the .22 caliber derringer seized at his residence on December 23, 1979.”
The predicate felony was that “Scarfo pled guilty to involuntary manslaughter in Pennsylvania state court in 1964.” The court held that admitting certain challenged papers was harmless error. The opinion prints no street address, and none is given here.
