United States Court of Appeals, Ninth Circuit, decided June 29, 1982.
“On July 14, 1981, appellant Spilotro was named in a nine-count indictment alleging that he and three co-defendants conducted the affairs of Gold Rush, Ltd., a Nevada corporation” doing business as a Las Vegas jewelry store, through dealing in stolen jewelry and wire fraud. On the date of the indictment the district court granted the government’s ex parte motion restraining the defendants from disposing of Gold Rush property. Spilotro appealed as the company’s officer, director, and sole stockholder.
The court remanded for “a full evidentiary hearing and adjudication of the issues presented” and retained jurisdiction. The opinion decides the restraining order only; it does not decide the charges.
