United States Court of Appeals, Eighth Circuit, submitted October 12, 1984, decided February 24, 1986. The appellants are Anthony John Spilotro, John Phillip Cerone, and Joseph P. Aiuppa.

The indictment was returned September 30, 1983 in the Western District of Missouri. The opinion summarizes the charge: “The government alleged that appellant Spilotro and others acted as the Las Vegas representatives for those co-conspirators, including appellants Aiuppa and Cerone, who lived in or near Chicago, Illinois.” It also states that “The government specifically alleged that appellant Aiuppa and defendants Joseph Lombardo and Frank Peter Balistrieri used their influence with certain trustees” of the Teamsters pension fund to obtain the loan for Allen Glick’s purchase of the casinos.

The appeals concerned bail conditions, including a condition restricting association. The opinion records that Aiuppa and Cerone were found guilty by a jury on January 21, 1986, which made their bail appeals moot. The court dismissed those two appeals. Spilotro had been severed for a separate trial, and his appeal was remanded so that the magistrate could decide whether the association condition was appropriate for him.
