A drawing by Clifford K. Berryman in the Records of the U.S. Senate (Record Group 46), series "Berryman Political Cartoon Collection" (NAID 306080), whose use note reads: "Some records in this series may be subject to copyright restrictions. It is the responsibility of the researcher to determine the copyright holder and arrange for permission to reproduce the items, if necessary." The item record reads "Use Restriction: Unrestricted." Berryman was a newspaper cartoonist, not a federal employee, so 17 U.S.C. § 105 is not the basis, and a drawing published after 1930 may still be under a renewed copyright. As with the 1932 Capone drawing filed here, no copy is stored; the National Archives serves the drawing at the cited URL.

The catalog title is “Oh So Tempting,” local identifier I-008, dated 10 June 1932. An elephant stands on a barrel marked “WATER WAGON” with a man labelled “FESS”; a donkey in a “WET TROUGH” calls, “COME ON DOWN KID. THIS IS THE LIFE!”

The National Archives note says the drawing portrays the opposing Republican and Democratic platforms on Prohibition: the Democrats supported “a clear-cut repeal of the 18th Amendment,” approved 934-3/4 to 213-3/4, and the Republicans chose “a more ambiguous plank,” represented by the water wagon driven by Republican National Committee chairman Simeon Fess, with a minority repeal plank defeated “690-19/36 to 460-2/9.” The vote counts are the note’s and have not been checked against convention records here.
