Howard T. Winter

First-named of twenty-one defendants in the 1979 federal horse-race-fixing prosecution in Boston, United States v. Howard T. Winter et al.; the verdict transcript records the jury finding him guilty on count two, and the First Circuit affirmed his conviction in 1981. The opinions do not call him a member or leader of any group.

On the record

  • 1975 — The Vault OCR of a July 1975 Boston FBI report in Part 02 of the Bulger file prints "HOWARD T. WINTER" in a broken, partly redacted passage. The reading has not been checked on the page image, and this archive does not state what the passage says.
  • 1979 — National Archives catalog: the case concerns "a 52-count indictment returned by a federal grand jury against 21 defendants for their alleged participation in a racketeering scheme involving fixing pari-mutuel thoroughbred horse races through bribery." Winter is listed first. An indictment is a charge.
  • 1979-05-08 — The digitized transcript of the fourth day of the jury trial, before Judge A. David Mazzone in Boston, holds the Government's opening statement and the testimony of Anthony Ciulla.
  • 1979-07-11 — Verdict transcript, page 45-4: "On count two, how do you find the defendant, Howard Winter?" The foreman answers "Guilty." The page does not say what count two charged.
  • 1981-10-30 — United States v. Martorano, 663 F.2d 1113: the First Circuit affirms the denial of new-trial motions by Winter and five codefendants, and notes that "there was no testimony in the case by Ciulla, or anyone else, that Winter was a member of the organized crime syndicate in New England." The court's separate opinion of the same day on the direct appeals, United States v. Winter, 663 F.2d 1120, affirmed his conviction.

The records filed here concern one prosecution, for fixing horse races. None of them uses the name “Winter Hill” for a group: the 1981 direct-appeal opinion mentions the “Winter Hill area” only as a place, and the new-trial opinion records that, at the defendants’ request, the trial court barred any reference to “organized crime by that name.” Later federal records filed with this archive’s New England material call James Bulger and Stephen Flemmi leaders of “the Winter Hill Gang”; they do not say so of Winter, and this page does not either. No role is set.
